In recent times, layoffs or reductions in the work force have become common. While this is part of doing business in a tough economy, the law provides strong protections against employee discrimination.

Your employer is not allowed to use a round of layoffs as an opportunity to get rid of a select group of individuals. For example, if your company only let go individuals older than 40 and held onto those who were younger, it may justify a discrimination claim.

Under the Worker Adjustment and Retraining Notification Act (WARN), most employers with 100 or more employees must provide a 60-day advance notification of any plant closing or mass layoff. If you were part of a large layoff and did not receive any advance notice, you may have a claim against your employer.
